Litigation & Dispute Resolution Services in the UAE

Litigation is the final stage of legal solutions when settlement and negotiations between the parties fail. In UAE law, litigation is the formal legal process through which individuals and companies resort to the courts to resolve disputes and protect their legal rights.

This system is governed by the UAE Civil Procedure Law (Federal Decree-Law No. 42 of 2022), together with its amendments and implementing regulations, creating an advanced judicial framework that combines traditional court procedures with modern digital justice.

The UAE litigation system follows clear legal procedures depending on the jurisdiction and type of dispute.

Levels of Litigation in the UAE Courts

The United Arab Emirates follows a three-tier court system to ensure fairness and judicial review.

Courts of First Instance

These courts hear civil, commercial, labour, criminal, personal status, and real estate disputes for the first time.

Courts of Appeal

Either party may appeal the judgment if they believe there has been an error in law or fact. The Court of Appeal reviews both legal and factual issues.

Court of Cassation / Supreme Federal Court

This is the highest judicial authority and reviews only the proper application of law and procedural compliance without reconsidering factual evidence.

Judicial Systems in the UAE

Federal Judicial System

The federal judiciary operates under the supervision of the UAE Ministry of Justice and serves the emirates that participate within the federal judicial framework.

Local Judicial Systems

Dubai, Abu Dhabi, and Ras Al Khaimah each operate independent judicial systems while remaining fully aligned with the general principles of UAE federal legislation.

Key Principles of Litigation

The UAE has transformed litigation into a highly efficient digital judicial system, reducing delays while maintaining procedural fairness.

Smart Digital Justice

Lawsuits may be filed electronically, hearings conducted remotely, applications submitted online, and judgments issued through secure digital platforms.

Digital Court Notifications

The courts notify parties through approved electronic channels including SMS, email, UAE Pass, and other digital communication systems.

Mandatory Amicable Settlement

For certain categories of disputes, UAE law requires parties to attempt mediation or reconciliation before formal litigation begins.

Public Hearings and Right of Defence

Both parties have the legal right to present evidence, appoint legal representatives, and defend their interests throughout court proceedings. Hearings remain public unless confidentiality is legally required.

If you would like legal advice regarding litigation procedures, appeals, settlements, or dispute resolution, FHS Solutions provides comprehensive legal representation and advisory services.

Legal Steps of Litigation in the UAE

Litigation in the UAE follows a structured legal process that begins with attempts to resolve disputes amicably before proceeding through the court system.

1. Amicable Settlement Stage

For certain categories of disputes, UAE law requires the parties to first attempt an amicable settlement before filing a lawsuit.

These include personal status matters, labour disputes, and tenancy disputes.

The lawyer submits a settlement request before the competent reconciliation committee. If an agreement is reached, it becomes an enforceable legal document. If settlement fails, the committee issues a referral letter allowing the claimant to proceed before the court.

2. Preparing the Statement of Claim

The claimant or their lawyer prepares the statement of claim, including:

  • Details of both parties.
  • Facts and background of the dispute.
  • Legal grounds supporting the claim.
  • Specific relief sought (compensation, contract termination, payment, etc.).
  • Supporting evidence such as contracts, invoices, and correspondence translated into Arabic where necessary.

3. Electronic Case Registration

The lawsuit is filed electronically using UAE Pass through the relevant judicial platform.

Federal Courts

Cases relating to Sharjah, Ajman, Umm Al Quwain, and Fujairah are filed through the Ministry of Justice electronic services.

Local Courts

Cases relating to Abu Dhabi or Dubai are submitted through the respective judicial department portals.

The system automatically calculates court fees based on the claim value and case type before assigning the case number and first hearing date.

4. Digital Court Hearings

The defendant receives official court notifications through approved digital channels, including SMS, email, and electronic judicial platforms.

Most hearings are conducted remotely through secure video conferencing systems.

Both parties exchange legal memoranda, submit supporting documents electronically, and present evidence until the pleadings are closed.

5. Judgment and Appeal

Once the court has examined all evidence, the judgment is issued electronically.

If either party disagrees with the judgment, an appeal may be filed before the Court of Appeal within the legally prescribed period, which is generally thirty days unless otherwise provided by law.

Example of Litigation in Practice

The Dispute

A foreign investor purchased an off-plan residential apartment in Abu Dhabi and paid 70% of the purchase price. The developer failed to deliver the property more than eighteen months after the agreed completion date.

Attempted Settlement

The investor first referred the dispute to the court's reconciliation and mediation centre. As settlement negotiations failed, the matter proceeded to litigation.

Court Proceedings

The litigation lawyer filed a contract termination and compensation claim electronically, attaching the sale agreement, payment receipts, and official evidence confirming the construction delay.

The court appointed an engineering expert, whose report confirmed that construction had reached only 25% completion and that the developer had no lawful justification for the delay.

Judgment

The Court of First Instance terminated the sale agreement, ordered the developer to refund AED 1.5 million, awarded additional compensation, and required the developer to pay court fees and legal costs.

After the appeal period expired, enforcement proceedings were initiated electronically, resulting in the seizure of the developer's bank account and the transfer of the awarded compensation directly to the investor.
